French luxury brand Chanel (Chanel) and French fashion group Molly Bracken have disputes over the trademark dispute over "Gabrielle" for more than two years, and Chanel finally lost.
In April 27th, UK's s Intellectual Property Office rejected the lawsuit filed by Chanel. Chanel said it registered the brand name "Chanel 's Gabrielle" in December 2017. Molly Bracken founded the Gabrielle brand as early as 2016. In the end, Chanel lost the lawsuit and was asked to compensate Molly Bracken for the legal cost.
In 2008, Catherine Sidonio and Julian Sidonio founded Molly Bracken, a small garment company in southern France, employing 240 employees. The group includes women's clothing brand Molly Bracken, children's wear brand Mini Molly and city fashion brand Lili Sidonio. After that, they added a large size brand of women's clothing and named it Gabrielle. Molly Bracken registered the trademark "Gabrielle" in October 2016. Molly Bracken said that the name "Gabrielle" came from the goddess Mousika of French painter Ole Noah (Auguste Renoir).
"Gabrielle" is also the name of fashion legend and Chanel founder Coco Chanel (Chanel's original name is Gabrielle Bonheur Chanel). Chanel currently has about 20 thousand employees worldwide, with an annual income of nearly 10 billion euros. In 2017, Chanel launched the Gabrielle perfume. In December of the same year, Chanel registered the trademark of "Chanel 's Gabrielle" for handbags and a range of other products. The next year, the Gabrielle de Chanel handbag series debuted.
Chanel first filed a lawsuit in a Swiss court when Molly Bracken won the lawsuit. After that, Chanel filed a lawsuit again in the British court, and the headquarters of its holding company, Chanel Ltd, is in the UK.
Molly Bracken said in a press release: "in November 2019, a trademark registrant thought that" Chanel s Gabrielle "is very similar to our Gabrielle brand name in terms of vision, pronunciation and concept, which may confuse consumers. Finally, the British Intellectual Property Office rejected Chanel's application for registering the Chanel 's Gabrielle trademark for its handbags and other products.
"This is good news for our company," said Julian Sidonio, CEO of Molly Bracken. "The legal dispute is over. We can continue to develop our business without interference, especially the expansion of Gabrielle without fear that big companies will initiate new lawsuits against us.
Molly Bracken has predicted that the company's revenue will grow by 20% over the same period in 2020. Molly Bracken's orders come mainly from the United States. It expects us sales to be two times faster than Europe's. But the company did not disclose its financial expectations after the outbreak.
Molly Bracken is currently being sold through 7000 retailers worldwide, of which Gabrielle brand has 3500 cooperative retailers. Molly Bracken says Gabrielle brand is "growing strongly". "Everything is going smoothly," Julian Sidonio said. "Customers asked us to provide Gabrielle products of all sizes. We are repositioning Gabrielle to expand product coverage to cater for smaller size and higher end customer demand.
